Mexico's defense presented three arguments to overturn the PLCAA

The Mexican government and US gun manufacturers presented their arguments before an appeals court to decide whether the second lawsuit filed by our country against the arms manufacturers will proceed or not.

 

This comes after a Massachusetts Court rejected a first lawsuit filed by Mexican authorities in September.

 

The Court argued that Mexico's legal battle was not valid because the gun manufacturers could not be held responsible for illegal acts committed by other individuals, according to the US Lawful Commerce in Arms Act (PLCAA).

 

Additionally, the Mexican government accused the gun manufacturers of negligence in allowing illegal arms trafficking, a situation that allegedly exacerbated violence in our country.

 

On this occasion, Mexico's defense presented three arguments to overturn the PLCAA. The first one is that this law does not apply to damages committed outside the USA; the second is that there are legal precedents demonstrating that gun manufacturers have faced lawsuits for shootings or massacres in the USA, and the third argument is related to the extraterritorial application of each nation's laws.

 

After the presentation of the arguments, the judges are expected to conduct a thorough review to take up the case and enter a phase of evidence production. Otherwise, the case would be dismissed again.

 

The resolution could take between six and eight months.
