The change aims to support employers, boost the economy, and reduce disruptions in employment authorization

The United States Citizenship and Immigration Services (USCIS) has announced a significant extension of the validity period for Employment Authorization Documents (EADs) for immigrants in the process of obtaining lawful permanent residence, beneficiaries of Temporary Protected Status (TPS), and other eligible categories. This measure, set to take effect on January 13, 2025, will automatically extend employment authorization for up to 540 days, compared to the current 180 days, for those who file timely renewal applications.

The agency, part of the Department of Homeland Security (DHS), stated that this change aims to support employers, boost the economy, and reduce interruptions in employment authorization.

According to USCIS Director Ur M. Jaddou, the measure also responds to feedback from the business community and addresses a backlog of over 9.2 million pending applications as of June. Among USCIS's main objectives are reducing processing times for applications, extending the validity of EADs from two to five years for certain categories, and enhancing online filing options for some applicants.

Immigrants applying for a renewal will need to submit valid documents supporting their eligibility, including Form I-797C as proof of the automatic extension. This new rule represents a significant effort to strengthen the economy and improve access to employment for thousands of people in the United States.
